Criminal conviction for cyberbullying? Yes, it's possible

Cyberbullying is a problem in Colorado and across the United States. It is easy to do and no one is immune to it. Cyberbullies often feel that they are uncensored and can get away with such activity. However, it is possible for an individual engaging in such activity to face charges and a criminal conviction.

Cyberbullying is the willful and repetitive attacking or harassing of someone online. It may be a known someone or an individual one only interacts with on the web. This can be done via any device that has access to the internet.

Many believe that cyberbullying is a young person problem. While teenagers may be behind a lot of these types of problems, numerous adults also engage in online harassment. Examples of cyberbullying include:

  • Posting inappropriate or embarrassing pictures of the victim
  • Leaving mean or uncalled for comments
  • Sending harassing emails

Again, for any of these things to be considered cyberbullying, they have to be done with the intent to cause harm and done repetitively. Colorado residents accused of cyberbullying may face harassment charges or worse -- depending on what happened to the victim. The consequences of a criminal conviction may include fines, jail time or both -- among others. Those who are facing charges for cyberbullying do not have to fight them alone. With the assistance of an experienced criminal defense attorney, those facing charges for cyberbullying can take the steps necessary to either fight the accusations in the hopes of seeking a case dismissal, or seek to reduce charges and any associated consequences by pursuing a plea agreement.
