Initial press reports of an alleged crime in Colorado may be difficult to understand if the police have released few facts about the events or if the press provides too little space for reporting the facts in detail. These may be factors in getting the full picture of what was behind the arrest of a 46-year-old-man in Colorado Springs recently for allegedly threatening co-workers with a handgun. The man was eventually captured, but police did not reveal the precise criminal charge filed against him.

The business manager of an undisclosed business located on South Wahsatch Avenue called 911 at about 10 a.m. on Jan. 31. When the police arrived, the man had already fled and police left the scene. However, the business manager called police again after they left, reporting that the perpetrator had returned.

When police came the second time, the suspect apparently fled in his vehicle but got hung up in heavy traffic, abandoned his vehicle and started running on foot. The police apprehended him shortly thereafter. It is unknown what charges were filed, but presumably they were in the nature of assault charges or making terroristic threats.

Another detail missing from the report is whether the man used the gun in any way. The lack of information, however, tends to indicate that no shots were fired. If that is the case, it would support a lesser criminal charge per Colorado law. The reasons for the suspect’s state of agitation is also unknown at this time. Defense counsel will need to quickly unravel and learn all of the facts surrounding the events to determine if the defendant has a strong defense or whether his emotional condition requires seeking an alternative disposition that does not require incarceration.
