How Is Property Divided in a Divorce?

Colorado is a community property state. This means that all property and debts acquired during the marriage are considered marital property and are divided equally between the spouses when the marriage ends.

In addition, a judge has the ability to divide property outside of this 50/50 split if the couple agrees. This is often the case for very valuable property, such as a business or a professional practice.

There are four main factors that a judge will consider when dividing property:

  • the value of the property
