Colorado Negligence Laws

What is modified comparative negligence? It is a legal doctrine where a claimant can recover damages from a defendant as long as the claimant’s negligence is less than 50% of the total negligence attributed to all parties. The claimant’s recovery is then reduced by their percentage of fault.

Colorado adheres to this principle as outlined in Colorado Revised Statute § 13-21-111. This encourages personal responsibility but still allows recovery in many cases where the claimant was not the sole or majority cause of the incident.
